Terms and Conditions for the Living Unbridled Program

Beyond the Arena LLC (hereinafter "Unbridled Retreats," "we," "us," "our") is a retreat provider that seeks to empower women while participating in equine retreats and online coaching programs. Our retreats and coaching programs use our unique intuitive Equine Coaching and Life coaching methodologies to help women learn to trust their intuition and move forward. We are excited to serve our clients (hereinafter "Client," "you") and help you experience positive transformation in your life.

We are offering a unique post-retreat program to our retreat alumni. The Living Unbridled Program is a six-month personal development program open only to retreat alumni culminating in an exclusive five-day Living Unbridled Retreat at White Stallion Ranch in Arizona.

Contract

We draw your attention to the Terms and Conditions below, these Terms and Conditions including all brochures, documents, correspondence, and the terms and conditions of our suppliers form the basis of the contract with you. Before joining the Unbridled Program (the Program), you must ensure that you have read and understood these Terms and Conditions (and ask any questions you may have). Please be aware that these Terms and Conditions contain waivers of liability as well as waiver of class action and venue selection and notice clauses. By asking us to confirm your reservation in the Unbridled Program you are accepting all the Terms and Conditions laid out below and acknowledging that you have read the Terms of this Contract and agree with it.

You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, and (c) your being denied access to the applicable travel-related product or service.

Changes to These Terms and Conditions

Unbridled Retreats reserves the right, in our sole discretion, to change these Terms and Conditions at any time. Upon making changes, we will notify you via the email address you provide to us at booking. The current terms will apply to all services in your booking. You must, therefore, be familiar with the terms in effect at the time you book. Your continued use of our services, including continuing to use or maintain any bookings after notice of any changes to the Terms and Conditions, constitutes your consent to the changes.

Enrollment

The Program is right for you if you are an alumni of one of our previous retreats, you are looking to take the next step in your personal development, and you want to learn how to continue to apply the Unbridled principles. You can choose to make a one-time payment or enroll in a payment plan. We may also allow for other payment arrangements at our sole discretion.

Once the program deposit is received, your enrollment into the Living Unbridled Program will be confirmed, and you'll receive a Welcome email with important information related to the program.

Upon enrolling under a payment plan you will authorize us to make automatic withdrawals from your account until paid in full. If any withdrawal is not available due to insufficient funds, we reserve the right to cancel your booking and apply the cancellation charges set out in the cancellation section below. In such a case this would be considered a cancellation by you and the cancellation terms and fees as described below would be in effect.

Credit Card Payments

We do accept major credit cards including Visa, Mastercard, American Express, and Discover. By signing these Terms and Conditions, you agree for us to charge your card, and your signature is an acknowledgment and agreement to these terms and conditions including the cancellation terms. As such you agree not to make any improper chargebacks.

In certain cases, you have the ability to dispute charges with credit card companies ("chargebacks"). Before initiating a chargeback, we ask you first to call us to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. Unbridled Retreats retains the right to dispute any chargeback that is improper and recover any costs, including attorney's fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are improper, and we retain the right to investigate and rebut any such chargeback claims:
-Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.
-Chargebacks resulting from charges authorized by family, friends, associates, or other third parties with direct access to your credit card. This does not include credit card fraud.
-Chargebacks arising from inconsistency or inaccuracy with regard to the supplier's product description.
-Chargebacks resulting from force majeure or other circumstances that are beyond the control of Unbridled Retreats or the Supplier.
-Chargebacks resulting because you do not agree with the cancellation policy.

Advertised Prices/ Price Changes From Suppliers

We reserve the right to make changes to and correct errors in advertised prices at any time before your enrollment is confirmed. We will advise you of any errors of which we are aware and of the then applicable price at the time of booking.

The price of the Program includes a five-day retreat. We reserve the right to add a supplement to your travel prices should our costs of supplying your travel increase, until we receive your final payment. Any increase in your travel price will be as a result of changes in our costs of supplying your travel resulting from changes by our suppliers, dues, or taxes payable locally, currency fluctuations, and government action. If our costs to supply your travel increase, we reserve the right to increase the price of your travel and will forward a new Invoice reflecting any changes made. After final payment, your price is locked in.

What's Included in the Program

Virtual Interactive Classes
Twelve virtual interactive classes applying Unbridled life and equine coaching principles into profound, actionable development. Every virtual class includes experiential exercises and practical tools designed for application in your daily life. We will at all times have full control of every meeting as we see fit in order to accomplish the goals of the group. If you behave in a way that detracts from the group or that we determine is not fit for the group, we may ask you to leave the class, or we may as a host, disconnect you from the class. In any such case, there will be no refund. As a courtesy to others in the group, we ask that you be on time for all scheduled interactive classes. Classes will begin on-time and failure to log in will be considered a no-show for which no refunds will be available.

Private Coaching Sessions
Six private 45-minute coaching sessions with a designated Certified Unbridled Equine Coach. Monthly private coaching sessions provide extra support to integrate transformative group lessons. We know that sometimes topics and discussions can bring up experiences or emotions that you don't feel comfortable discussing in a group setting. Having a monthly private session allows you to relax in the group setting, knowing you will have additional time and support reserved for you privately. Private sessions will begin on-time and failure to log in within ten minutes of your start time will be considered a no-show for which no refunds will be available. Note that any Private Coaching Sessions unused by 7/1/2025 will expire and will not be available thereafter. No refunds will be available for unused sessions.

Ticket to Living Unbridled Retreat
Exclusive ticket to a 5-day Living Unbridled Retreat at White Stallion Ranch (March 2 - 6, 2025). Participation in the Living Unbridled Retreat is subject to our Retreat Terms and Conditions (Retreat Terms) which can be found at https://unbridledretreats.com/terms-and-conditions/. In case of any inconsistencies between Retreat Terms and this Contract, this Contract shall prevail.

Use of Virtual Meeting Websites

To join classes and coaching sessions you will be provided a link to an online meeting service provider. By providing this link we are not endorsing or recommending the service provider. The presence of a link in any way should not be construed as a suggestion that the site has any relationship with Unbridled Retreats. When using this link please remember:
-We are not responsible for the content, product, and services provided by linked sites.
-We do not guarantee the services provided by linked sites, including that the site will function properly.
-We are not liable for any failure of the site.
-We are not responsible for any damage to equipment from the site including that from viruses, trojans, etc.
-The linked website may have a privacy policy different than that of Unbridled Retreats.
-The linked website may provide less security than that of Unbridled Retreats.

Your Device Functionality

You are responsible for obtaining and maintaining your device, software, operating system, carrier, and network access necessary to properly access and use the Services. We do not guarantee that the online service or any portions thereof will function on or in connection with any particular device, software, operating system, carrier, or network. We will have no liability for errors, unreliable operation, or other issues resulting from the use of an online service provider or in connection with rooted or jailbroken devices or use on any mobile device that is not in conformance with the manufacturer's original specifications, including, but not limited to, use of modified versions of the operating system. All rate and data fees of your device’s carrier apply to your use of any online service, and Unbridled Retreats is in no way responsible for your carrier rates and data fees, where applicable.

Disclaimer/Limitation of Liability

ALL UNBRIDLED RETREAT SERVICES, INCLUDING EQUINE COACHING, ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY, AND ARE NOT INTENDED TO DIAGNOSE ANY MEDICAL, PSYCHOLOGICAL, OR HEALTHCARE CONDITION, REPLACE THE ADVICE OF A LICENSED HEALTHCARE PROFESSIONAL, OR PROVIDE ANY MEDICAL ADVICE, OPINION, DIAGNOSIS, TREATMENT OR GUARANTEE. ANY UNBRIDLED RETREAT EMPLOYEES YOU WORK WITH ARE NOT FUNCTIONING IN ANY CLINICAL OR LICENSED MEDICAL OR PSYCHOLOGICAL CAPACITY; SUCH INDIVIDUALS ARE SOLELY PROVIDING INFORMATIONAL AND EDUCATIONAL SELF-HELP RESOURCES. THUS, IT IS EXTREMELY IMPORTANT THAT YOU CONSULT YOUR PHYSICIAN, THERAPIST, PSYCHOLOGIST, OR LICENSED HEALTHCARE PROVIDER – AND NOT UNBRIDLED RETREATS, OUR EMPLOYEES, AGENTS AND/OR THIRD-PARTY SERVICE PROVIDERS – IN CONNECTION WITH YOUR MEDICAL, PSYCHOLOGICAL, OR HEALTH CONDITION. YOUR USE OF ANY OF OUR SERVICES DOES NOT CREATE A DOCTOR-PATIENT, PROFESSIONAL-CLIENT, OR SIMILAR RELATIONSHIP BETWEEN YOU AND UNBRIDLED RETREATS OR YOU AND ANY EMPLOYEE, OR AGENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, UNBRIDLED RETREATS AND ANY OF UNBRIDLED RETREATS’ OFFICERS, DIRECTORS, MEMBERS, MANAGERS, OWNERS, SHAREHOLDERS, PARTNERS, AGENTS, EMPLOYEES, REPRESENTATIVES, AFFILIATES, SUCCESSORS, ASSIGNS, TRANSFEREES, CONTRACTORS, OR LICENSEES, ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE OR SPECIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM ANY DAMAGES FOR PERSONAL OR BODILY INJURY OR EMOTIONAL DISTRESS, INCLUDING DEATH) CAUSED BY OR ARISING FROM OR IN CONNECTION IN ANY WAY TO THE PROGRAM, PRODUCTS, SERVICES, CONTENT OR INFORMATION CONTAINED WITHIN THE PROGRAM, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE PROGRAM OR SERVICES IS TO STOP USING THE PROGRAM OR THOSE SERVICES. TO THE EXTENT ANY ASPECTS OF THE FOREGOING LIMITATIONS OF LIABILITY ARE NOT ENFORCEABLE, THE MAXIMUM LIABILITY OF UNBRIDLED RETREATS, TO YOU WITH RESPECT TO YOUR USE OF THE PROGRAM IS THE PROGRAM PRICE. YOU HEREBY AGREE TO WAIVE, TO THE FULLEST EXTENT PERMITTED BY LAW, ALL LAWS THAT LIMIT THE EFFICACY OF SUCH LIMITATIONS OR RELEASES.

ANY CLAIMS ARISING IN CONNECTION WITH YOUR USE OF THE PROGRAM OR SERVICES MUST BE BROUGHT WITHIN ONE (1) YEAR OF THE DATE OF THE EVENT GIVING RISE TO WHEN SUCH ACTION OCCURRED. EXCEPT AS EXPLICITLY PROVIDED HEREIN, YOU UNDERSTAND AND AGREE THAT YOUR USE OF THE PROGRAM OR SERVICES IS PREDICATED UPON YOUR WAIVER OF ANY RIGHT TO PARTICIPATE IN A CLASS ACTION SUIT FOR ANY LOSSES OR DAMAGES RESULTING FROM YOUR USE OF THE PROGRAM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. TO THE EXTENT THAT WE MAY NOT DISCLAIM ANY IMPLIED WARRANTY OR LIMIT ITS LIABILITIES, THE SCOPE AND DURATION OF SUCH WARRANTY AND THE EXTENT OF OUR LIABILITY WILL BE THE MINIMUM PERMITTED UNDER APPLICABLE LAW.

Release

You hereby release and hold harmless Unbridled Retreats from and against all claims that you have or may have against them for infringement, violation of the rights of privacy or publicity, defamation, disparagement, personal injury, property damage, negligence and/or any other legal theory arising from or in connection with the Program or Services.

If you are a California resident, you waive California Civil Code Section 1542, which provides:

A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.

If you are not a California resident, you waive your rights under any statute or common law principle similar to Section 1542 that governs your rights in the jurisdiction of your residence.

No Refunds for Unused Portion

There will not be any refund for any unused portion of the Living Unbridled Program. If you cancel while the program is in process, there is no refund for the unused portion. If you are unable to attend the March 2 - 6, 2025 Living Unbridled Retreat at White Stallion Ranch, no refunds are available.

If the reason for cancellation or the Retreat is covered under the terms of your travel protection plan you may be able to reclaim these charges, for this reason we strongly encourage the purchase of a travel protection plan including additional cancel for any reason coverage.

Cancellations

All payments are non-refundable.

Cancellation of Changes by Unbridled Retreats

We reserve the right to cancel or reschedule any online class or coaching session for any reason. If we cancel, we will reschedule within a reasonable time period. No refunds will be available for rescheduled classes or coaching sessions.

No Resale of Services Permitted

Client agrees not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of the Program and Retreat (including course materials), use of the Program and Retreat, or access to the Program and Retreat. This agreement is not transferable or assignable without the Company’s prior written consent.

Force Majeure

You understand and acknowledge that the Program may be subject to limitations, delays, and other problems inherent in the use of third-party communication networks and facilities that are outside of Unbridled Retreats’ control, and thus Unbridled Retreats will not be responsible for any delays, failures, or damages associated with the Program which result from any system delays, downtimes, interruptions, or other failures of or problems with the Program which are outside of Unbridled Retreats’ control. We will not be deemed to be in breach of or liable for any breach of these Terms due to any event or occurrence beyond our reasonable control, including without limitation, acts of God, terrorism, war, invasion, epidemic, pandemic, acts of governmental authorities and changes in federal, state, or local laws and regulations applicable to the provision of Services, failures of any public networks, electrical shortages, earthquakes or floods, civil disorder, strikes, fire, or other disaster.

No Transfer of Intellectual Property

Company’s copyrighted and original materials shall be provided to the Client for his/her individual use only and a single-user license. Client shall not be authorized to use any of Company’s intellectual property for Client’s business purposes. Client shall not be authorized to share, copy, distribute, or otherwise disseminate any materials received from Company electronically or otherwise without the prior written consent of the Company. All intellectual property, including Company’s copyrighted course materials and photography, shall remain the sole property of the Company. No license to sell or distribute Company’s materials is granted or implied.

Governing Law/Jurisdiction

This Agreement and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Colorado exclusive of conflict or choice of law rules. Any claims shall be brought in a court of competent jurisdiction located in Colorado.

Severability and Entire Agreement

In the event that any of the Terms are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect. These Terms, and our Retreat Terms constitute the entire agreement between Unbridled Retreats and you pertaining to the subject matter hereof.
